Fair Debt Collection Practices Act (FDCPA)

The Fair Debt Collection Practices Act offers consumers the best available protection from abusive or annoying debt collectors. The FDCPA prohibits debt collectors from using unfair, deceptive, or abusive practices when collecting personal, family, and household debts, including car loans, medical care, and charge accounts.

The FDCPA states that:

Debt collectors may only contact consumers between 8 a.m. and 9 p.m.

If debt collectors know a debtor's employer disapproves, they may not contact that person at work.

Debt collectors must not harass, abuse, or oppress their debtors.

Debt collectors may not lie while collecting debts, such as falsely implying that a consumer has committed a crime.

Debt collectors must identify themselves clearly on the phone - they may not disguise their identity or purpose.

If a consumer requests, in writing, that debt collectors stop contacting them, the debt collectors must comply.
